Driving While Impaired - Participant Guidebook Page 14 • The legal BAL limit is .08. • Drivers will be considered intoxicated if they have a BAL of .08 or more. However, you can still be convicted of a DUI if your BAL is below this level, if there is sufficient evidence that your driving was impaired. Drunk driving can also lead to jail sentences in some cases. • Drivers shall not operate a motor vehicle while under the influence of any intoxicating drug. • Drivers consent to chemical tests of their blood, breath, or urine if arrested for driving under the influence when they operate a motor vehicle. • If drivers refuse to take a test, their driving privileges are automatically suspended for 1 year. • Drivers will be required to install an ignition interlock device if they have multiple DUI convictions or if their first conviction is for a BAL of .15 or above. First time offenders with a BAL of below .15 may be required to install a device at the court's discretion. • Any driver under 21 years of age who is stopped by law enforcement and has a BAL of .02 or higher will automatically have their driving privilege suspended for six months. If their BAL is .05 or higher, they will also be required to attend a substance abuse course. UNIT 3 – Are We Ready to Drive? Child Safety Seats - Participant Guidebook Page 37 • Children 5 years of age and younger in a motor vehicle must be restrained in a federally-approved child restraint device. • For children up to 3 years of age, the restraint device must be a separate carrier or a vehicle manufacturer's integrated seat. • For children aged 4 through 5 years, a separate carrier, an integrated child seat, or a booster seat may be used. A seat belt is sufficient if the child is not a member of the driver's immediate family, in emergency situations or when the child has a medical condition that makes them unable to use any of the restraint devices listed above. • Any person who violates the child restraint requirements commits a moving violation and can have 3 points assessed against his/her driver's license. • If the passenger is 18 years of age or older and fails to wear a safety belt when required by law, the passenger will be charged with the violation. • For persons less than 18 years of age, a seat belt violation is treated as a primary enforcement. Any person who violates the provisions of this Safety Belt Law commits a nonmoving violation, as is punishable under Florida law.
