Driving While Impaired - Participant Guidebook Page 14 Drivers will be automatically considered under the influence if they have a BAC of .08 or more. However, you can still be convicted of a DUI if your BAC is below this level, if there is sufficient evidence that their driving was impaired. Drivers shall not operate a motor vehicle while under the influence of any intoxicating drug. It is illegal for a person under age 21 to operate a motor vehicle with any detectable amount of alcohol in their system. Officers may conduct preliminary roadside analysis of a driver's breath if they have reason to believe that the driver is intoxicated. Drivers consent to chemical tests of their blood, breath, or urine when they operate a motor vehicle if reasonably suspected of driving under the influence, or if they refuse a preliminary breath test. A blood or urine test may be conducted only pursuant to a search warrant. Minnesota statutes provide criminal and civil/administrative penalties for test refusal. Refusal to submit to a test will result in the license revocation for one year or longer for multiple refusals. Action may be taken against a person who refuses to take a blood test only if a urine test was offered and action may be taken against a person who refuses to take a urine test. In 2018, Minnesota state law was enacted called the Little Alan's Law" The Little Alan's Law states that any operator of a motorized vehicle which includes but is not limited to boats, snow mobiles, and ATVs who is convicted of DUI will receive penalty and removal of their automotive driver's license. The Open Package Law was created, stating that it is a crime to use certain cannabis and hemp products when driving and that it is a crime to possess such products if they are removed from their package, opened, or in a non-sanctioned package while in a motor vehicle. Infants must ride in a rear-facing child safety restraint system until they are at least 1 year of age and weigh at least 20 pounds. Never put a rear-facing car seat in the front seat of a vehicle with a passenger air bag.
