Driving While Impaired - Participant Guidebook Page 14 • Drivers will be considered under the influence if they have a BAC of .08 or more. However, you can still be convicted of a DUI if your BAC is below this level, if there is sufficient evidence that your driving was impaired. The legal BAC limit for drivers under 21 are prohibited from operating a motor vehicle is .02. • Drivers shall not operate a motor vehicle while under the influence of any intoxicating drug. • Drivers consent to chemical tests of their blood, breath, or urine if arrested for driving under the influence when they operate a motor vehicle. Refusing a test can result in license suspension. • If a driver fails a BAC test they will have their license suspended. • Law enforcement officers can also conduct a voluntary preliminary breath test prior to arrest if they reasonably suspect the driver's abilities are impaired. • Ignition interlock devices are to be used upon the first conviction and every subsequent conviction thereafter. UNIT 3 – Are We Ready to Drive? Child Safety Seats - Participant Guidebook Page 37 • Children under the age of 2 must be restrained in a rear-facing child passenger restraint system with harness. • Children ages 2 or older, but under 4, must be restrained in a rear-facing or forward-facing child passenger restraint system with harness. • Children ages 4 or older, but under 10, must be restrained in a child passenger restraint system with harness or booster seat. • Children ages 7 or older, but under 10, who are over 4 feet 9 inches tall do not need to be restrained in a child passenger restraint system with harness or booster seat if they are restrained by a lap and shoulder seat belt assembly. Railroad Grade Crossings - Participant Guidebook Page 56 • It is illegal to drive around a railroad crossing gate, even if there is no train. • Drivers must stop at least 15 feet from the tracks, but no more than 50 feet away. • Drivers cannot move into the left lane to pass another vehicle within 100 feet of a railroad crossing. • Drivers shall drive at a safe and appropriate speed when approaching or crossing a railroad grade crossing.
