Driving While Impaired - Participant Guidebook Page 14 Drivers will be automatically considered under the influence if they have a BAC of .08 or more. However, you can still be convicted of a DUI if your BAC is .04 or more, if there is sufficient evidence that your driving was impaired. The legal BAC limit is .02 for drivers younger than 21. Drivers shall not operate a motor vehicle while under the influence of any intoxicating drug. Drivers consent to chemical tests of their blood, breath, or urine if arrested for driving under the influence when they operate a motor vehicle. Refusal to take a chemical test will result in a license suspension. Drivers convicted of a DUI or who refuse a test will be required to install an ignition interlock device. UNIT 3 – Are We Ready to Drive? Child Safety Seats - Participant Guidebook Page 37 Children under the age of 2 or 30 pounds must remain in a rear-facing child restraint with a 5-point harness. Children from the age of 2 to 5 and under 40 pounds must be in a front or rear-facing child restraint with a 5-point harness. Children should use a booster seat until they reach the age of 8 and 60 pounds. Drivers must exercise reasonable care when sharing the road with vulnerable users. Failure to do so will result in a fine. Drivers must follow a flagger's directions. If a driver is caught speeding through a construction zone at 75 miles per hour or higher, they must attend a driver education class, and may get points against their license. This limit is reduced to 65 miles per hour for commercial vehicle operators. Traffic fines are doubled in a construction zone. Railroad Grade Crossings - Participant Guidebook Page 56 It is illegal to drive around a railroad crossing gate, even if there is no train. Drivers must stop at a railroad crossing when warned of an approaching train by law enforcement or flashing lights erected at the crossing. It is illegal to parking on railroad tracks.
