Page 4 of 4 AARP Driver Safety Smart Driver™ Course State-Specific Information D20683 – May 2024 DELAWARE • Drivers must yield the right-of-way to any pedestrian within a crosswalk, stopping if necessary. • Drivers must not pass a vehicle stopped to allow a pedestrian to cross the highway. • Drivers must yield the right-of-way to any pedestrian carrying a white cane or any pedestrian who is accompanied by a guide dog. Crashes (Crash Reporting) – Participant Guidebook Page 86 • After a crash, the driver must attempt to determine whether any person involved in the collision was injured or killed. If such collision resulted in injury or death, the driver must report the crash to the police. • If damage to another vehicle or property occurred, the driver must exchange information at the scene with any party involved in the crash. • If the damage resulting from such collision is to the property of the driver only, the driver need not stay at the scene of the collision but shall immediately make a report of the damage to the police. • Accidents resulting in injury, death, or property damage over of $2000 or more must be reported to a police agency by the quickest means possible. ADDITIONAL STATE INFORMATION Course hours: The state DMV requires first time course takers take the full (6 hour) course. Repeat course takers may complete a shorter version (4 hour) of the course if it is within two years following the expiration of the initial course's discount period (three years). Course Discount and 3-point Credit: Drivers who complete an approved Defensive Driving Course may receive 10% off a portion of their auto insurance for three years. Drivers who take a refresher Defensive Driving Course within 180 days of the end of the three-year period may receive a 15% discount. A Delaware driver can receive a 3-point credit by taking a defensive driving course. Upon satisfactory completion of an approved defensive driving course the course provider will process all course completion paperwork and upload the information electronically to the DMV. This credit is applied to a driver's point total; it does not decrease your overall point value. The 3-point credit is only applied to future violations and does not remove or reduce existing DMV points. Defensive driving courses are valid for three (3) years.
