Driving While Impaired - Participant Guidebook Page 14 • Drivers shall not operate a motor vehicle while under the influence of any intoxicating substance. • Drivers will be automatically considered under the influence if they have a BAC of .08 or more. • You can be convicted of a DUI if your BAC is above .05, if there is enough evidence that your driving was impaired. • Drivers consent to chemical tests of their blood, breath, or urine is implied if suspected of driving under the influence when they operate a motor vehicle. Refusal to take a chemical test will result in a license suspension. • Drivers convicted of a DUI or who refuse a test will be required to install an ignition interlock device. • Delaware's zero tolerance statute mandates a license revocation for drivers under the age of 21 with a .02 BAC. If convicted of driving under the influence of alcohol, the minor's license shall be revoked for two months for the first offense and not less than six months, but not more than 12, for each subsequent offense. UNIT 3 – Are We Ready to Drive? Child Safety Seats - Participant Guidebook Page 37 (Effective June 30, 2024) • Children under the age of 16 must be properly secured in all seating positions according to the manufacturer's instructions, in a child safety seat or booster seat meeting federal motor vehicle safety standards, and that is appropriate for the child's age, weight and height, or a properly secured seat belt. • A child under the age of 2 years and less than 30 pounds must be properly secured in a rear-facing child restraint with a 5-point harness. • A child under the age of 4 and less than 40 pounds must be properly secured in a child restraint with a 5-point harness until they reach the upper height or weight limits of the restraint; the restraint can be either rear-facing or forward facing per the manufacturer's guidelines. • A child shall be properly secured in a belt-positioning booster seat until they reach the upper weight or height limits per the manufacturer's guidelines. • If a child has reached the upper height and weight limits of a belt-positioning booster seat and is still under the age of 16, they must wear a properly secured seat belt while in a vehicle in operation. • A child who is 5'5" or less in height and who is under 12 years of age cannot occupy the front passenger seat of a vehicle equipped with a passenger-side airbag unless the airbag has been rendered inoperable in conformity with federal law.
