Driving While Impaired - Participant Guidebook Page 14 • It is a crime for a driver to have a bodily alcohol content (BAC) of .08 or greater if over the age of 21 or .02 if under the age of 21. In addition, Michigan has a high-BAC law with enhanced penalties for anyone caught driving with a BAC of .17 or higher. • Drivers consent to chemical tests of their blood, breath, or urine if arrested for driving under the influence when they operate a motor vehicle. Refusing a test may result in a 1 year license suspension and 6 points against the driver's record. • Officers may conduct preliminary roadside analysis of a driver's breath prior to arrest if they have reason to believe that the driver is intoxicated. Refusing this test can result in up to 93 days of imprisonment and/or a fine. • Repeat offenders will be required to install an ignition interlock device. UNIT 3 – Are We Ready to Drive? Child Safety Seats - Participant Guidebook Page 37 • A child under 2 years of age must be secured in a rear-facing child restraint system, until the child reaches the weight or height limit of the child restraint system. • A child at least 2 years of age and under 5 years of age who has reached the weight or height limit of the rear-facing child restraint system must be properly restrained in a forward-facing child restraint system with an internal harness, until the child reaches the weight or height limit of the forward-facing child restraint system. • A child at least 5 years of age and under 8 years of age who exceeds the weight or height limit of the forward-facing child restraint system must be properly restrained in a booster seat and secured with a safety belt, until the child is 4 feet 9 inches. • A child must be transported in the rear seat of a motor vehicle, when available. Railroad Grade Crossings - Participant Guidebook Page 56 • It is illegal to drive around a railroad crossing gate, even if there is no train. • Drivers must stop at least 15 feet from the tracks, but no more than 50 feet away. • It is illegal to park within 50 feet of a railroad crossing.
