Driving While Impaired - Participant Guidebook Page 14 • Drivers will be considered under the influence if they have a BAC of .08 or more. However, you can still be convicted of a DUI if your BAC is below this level, if there is sufficient evidence that your driving was impaired. • Drivers will be considered under the influence if they operate a motor vehicle under the influence of any intoxicating drug. • Drivers consent to chemical tests of their blood, breath, or urine if arrested for driving under the influence of drugs or alcohol when they operate a motor vehicle. Refusing a test may result in license suspension. • Law enforcement officers can also conduct a voluntary preliminary breath test prior to arrest if they reasonably suspect the driver's abilities are impaired. • Drivers will be required to install an ignition interlock device if they have multiple DUI convictions. • A person convicted of a DUI with a BAC of .16% or more or a DUI while transporting a child under age 16 may be subject to enhanced penalties, fines community services and sanctions. Child Safety Seats - Participant Guidebook Page 37 • Children under the age of 8 must be restrained in a child safety seat. • Children under the age of 2 must remain in a rear-facing seat unless the child is at least 40 pounds or 40 inches tall. Construction Signs and Construction Zones - Participant Guidebook Page 49 • It is illegal to use a cellphone while driving in a construction zone. • Drivers must not exceed the posted speed limit in a work zone whether or not workers are present. • Violators of this provision will be fined for the first offense and additionally for any subsequent offense. Railroad Grade Crossings - Participant Guidebook Page 56 • It is illegal to drive around a railroad crossing gate, even if there is no train. • Drivers must stop at least 15 feet from the tracks, but no more than 50 feet away, if there is a posted stop sign, the electric signal is flashing, a train is audible or visible, or the crossing gate is lowered.
