If drivers use a hand-held mobile telephone while driving, except to call 911 or to contact medical, fire, or police personnel about an emergency, or use a device to text or send email, they can receive a traffic ticket and pay a fine and surcharge as described below. • The number of points assessed for convictions for violations involving the use of a mobile phone or involving the use of an electronic portable device (i.e. texting device) has been increased from three (3) to five (5) points. • Penalties increase in fine payment with each offense. Offenses are compounding if they are within 18 months of one another. • Drivers on probation or those with learners permits who violate this law will have their license suspended for a period of time following their first offense or at least one year following a second offense.
