Driving While Impaired - Participant Guidebook Page 14 Drivers will be automatically considered under the influence if they have a BAC of .08 or more. However, you can still be convicted of a DUI if your BAC is below this level, if there is sufficient evidence that your driving was impaired. It is unlawful to drive while under the influence of any intoxicating substance. Drivers consent to chemical tests of their blood or breath if arrested for driving under the influence when they operate a motor vehicle. Refusing a test may result in a license suspension. Drivers will be required to install an ignition interlock device if convicted of a DUI. A driver is guilty of Driving Under the Influence if their blood level registers a THC concentration of 5 nanograms or higher per liter of blood within two hours of driving. Child Safety Seats - Participant Guidebook Page 37 The operator of a vehicle is responsible for the properly adjusted restraint or approved child seat of all passengers under the age of 16. Persons over age 16 are responsible for their own proper restraint. A child is required to be properly secured in a rear-facing child restraint system until the age of 2 or until the child reaches the seat manufacturer-set weight or height limits. A child not secured in a rear-facing seat who is under the age of 4 is required to be properly secured in a forward-facing child restraint system until the child reaches the seat manufacturer-set weight or height limits. A child not secured in a forward- or rear-facing child restraint system who is under 4 feet 9 inches tall, is required to be properly secured in a child booster seat until the child reaches the seat manufacturer-set weight or height limits. A child who is under the age of 8 and is less than 4 feet 9 inches tall must be restrained in the appropriate child safety seat. A child who is 8 years old or older or taller than 4 feet 9 inches must be properly restrained using a motor vehicle's safety belt or an appropriately fitting child restraint system. A child under the age of 13 must be secured in the back seat where it is practical to do so.
