Driving While Impaired - Participant Guidebook Page 14 • Drivers will be automatically considered under the influence if they have a BAC of .08 or more. However, you can still be convicted of a DUI if your BAC is below this level, if there is sufficient evidence that your driving was impaired. • Drivers shall not operate a motor vehicle while under the influence of any intoxicating drug. • Drivers consent to chemical tests of their blood, breath, or urine if reasonably suspected of driving under the influence when they operate a motor vehicle. Refusing a test may result in a fine and a license suspension. • Officers may conduct a voluntary preliminary roadside analysis of a driver's breath prior to arrest if they have reason to believe that the driver is intoxicated. • First Offense: includes a fine, maximum 10 day jail sentence, 6 month license suspension. • Second and Subsequent Offenders: maximum fine, maximum 6 month jail sentence, 1 year license suspension. • Drivers will be required to install an ignition interlock device if convicted of multiple DUIs, and they may be required to participate in a sobriety or drug monitoring program. UNIT 3 – Are We Ready to Drive? Child Safety Seats - Participant Guidebook Page 37 • Children who are under 2 years of age must be restrained in a rear-facing child safety restraint system. • Children between 2 years of age and up to 4 years of age must be restrained in a rear-facing or forward-facing child safety restraint system with an internal harness. • Children between 4 years of age and up to 8 years of age must be restrained in a forward-facing child safety restraint system with an internal harness or booster seat that is secured with a vehicle lap-shoulder seat belt. • Children who are at least 9 years of age or who have outgrown the height or weight limits of a child booster seat, whichever comes first, must be secured by a motor vehicle adult safety belt. Railroad Grade Crossings - Participant Guidebook Page 56 • It is illegal to drive around a railroad crossing gate, even if there is no train. • Drivers must stop at least 15 feet from the tracks. • It is illegal to pass another vehicle within 100 feet of a railroad crossing. • It is illegal to park within 50 feet of a railroad crossing.
