Driving While Impaired - Participant Guidebook Page 14 • Drivers will be considered under the influence if they have a BAC of .08 or more. However, you can still be convicted of a DUI if your BAC is below this level, if there is sufficient evidence that your driving was impaired. • Drivers shall not operate a motor vehicle while under the influence of any intoxicating drug. • Drivers consent to chemical tests when they operate a motor vehicle. Drivers consent to chemical tests of their blood or breath if law enforcement has reasonable suspicion to believe they were driving under the influence of alcohol. Drivers also consent to chemical tests of their blood, saliva, or urine to determine whether they were driving under the influence of drugs. Refusal to take a chemical test will result in a license suspension. • Law enforcement officers can also conduct a preliminary breath test prior to arrest if they reasonably suspect the driver's abilities are impaired. • Courts are encouraged to order drivers convicted of a DUI to install an ignition interlock device. UNIT 3 – Are We Ready to Drive? Child Safety Seats - Participant Guidebook Page 37 • Children under 2 years old and weighing less than 40 pounds must ride in a rear-facing car seat in the back seat if one is available. They may continue rear-facing beyond 2 years and 40 pounds if the child restraint allows it. • Children under 2 years old who weigh over 40 pounds, as well as children 2–4 years old who weigh at least 20 pounds, must ride in a forward-facing car seat in the back seat if one is available. They may continue using a forward-facing car seat beyond 4 years and 40 pounds if the child restraint allows it. • Children at least 4 years old and over 40 pounds must use a booster seat. Children ages 4–9 and at least 40 pounds must ride in the back seat if one is available. They may continue using a booster seat beyond 9 years old if needed. • Children ages 9–18 must use a seat belt and ensure it fits properly for safety. Construction Signs and Construction Zones - Participant Guidebook Page 49 • Drivers must follow all signs and a flagger's directions. • Drivers must yield the right-of-way to all workers and construction and construction vehicles. • Fines are doubled for traffic violations within a construction zone. Railroad Grade Crossings - Participant Guidebook Page 56 • It is illegal to drive around a railroad crossing gate, even if there is no train. • Drivers must stop at least 15 feet from the tracks, but no more than 50 feet away.
