Driving While Impaired - Participant Guidebook Page 14 Drivers will be considered under the influence if they have a BAC of .08 or more. However, you can still be convicted of a DUI if your BAC is below this level, if there is sufficient evidence that your driving was impaired. Drivers shall not operate a motor vehicle while under the influence of any intoxicating drug. Drivers consent to chemical tests of their blood or breath if arrested for driving under the influence when they operate a motor vehicle. Urine tests are permitted only if both the blood and breath tests are unavailable, the driver is a hemophiliac, or the driver is taking anticoagulant medication. Law enforcement officers can also conduct a voluntary preliminary breath test prior to arrest if they reasonably suspect the driver's abilities are impaired. Drivers may be required to install an ignition interlock device upon conviction of a DUI. UNIT 3 – Are We Ready to Drive? Children less than eight years old cannot ride in the front seat. Drivers must stop at least 15 feet from the tracks when indicated by a lights or gate. No person shall park a vehicle upon any railroad track or within 7.5 feet of the nearest rail. The speed limit is 15 mph within 100 feet of a railroad crossing and you cannot see the tracks for 400 feet in both directions.
